On December 5, the New York Times podcast “The Daily” devoted an episode to the gender-affirming care case currently at the Supreme Court, U.S. v. Skrmetti.

Yesterday I recommended a couple other podcast episodes to learn about the case.

This 35-minute episode is called The Supreme Court Takes on Transgender Care for Minors. I’ll summarize it in 2 minutes. The guest is Adam Liptak, who covers the Supreme Court for the newspaper.

In short:

Plaintiffs (trans kids, the ACLU and the Biden administration) complain that Tennessee’s new law means that a boy (but not a girl) can take testosterone and that a girl (but not a boy) can take estrogen. This, they argue, is sex discrimination.

Defendants (the state of Tennessee) counter that the law only governs the purpose of the treatment. Under the law, a child may be prescribed puberty blockers for certain purposes, but not for…
