Yesterday, the Florida Senate and House voted to pass a bill called Treatments for Sex Reassignment (CS/SB 254). Governor Ron DeSantis is expected to sign it. There’s a lot in it. Buckle up—

What’s In the Bill

First, it defines ‘sex’ and ‘sex-reassignment’

The Florida Statutes, Section 456.001, will add Subsection (8) to define a person as having a “sex” of “male or female” based on their “specific reproductive role, as indicated by the person’s sex chromosomes, naturally occurring sex hormones, and internal and external genitalia present at birth.”

It will also add Subsection (9) to define “sex-reassignment prescriptions or procedures” as referring to “puberty blockers,” “hormones or hormone antagonists,” and any “medical” or “surgical procedure” whose purpose is “to affirm a person’s perception of his or her sex if that perception is inconsistent with the person’s sex.” Excluded is whatever is done to an intersex child, addresses complications of sex-reassignment procedures (like infection), or gives lifesaving medical care for “physical” (but not mental) concerns.
